TERMS AND CONDITIONS OF gamium v2 (General Terms and Conditions – “GTC”)

These General Terms and Conditions (“GTC”) govern the rights and obligations related to the use of the services offered by MCX Limited (Registration 2025-00750), operating commercially under the name gamium v2, mainly through the website www.gamiumexchange.com (the “Website”).

By registering on the Website or using the Services, you acknowledge that you have read, understood, and agreed to these General Terms and Conditions. If you do not agree with any part of these terms, you must not use the Services.


1. INTRODUCTORY PROVISIONS

1.1.
The provider of the Services is MCX Limited (Registration 2025-00750), with its registered office at The Sotheby Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia (hereinafter “gamium v2”, the “provider”, “we”, or “our”).

1.2.
The user of the Services is any natural or legal person who registers or uses the Services (hereinafter “you”, the “Client”, or the “Trader”).

1.3.
By registering on the Website or using the Services for the first time, a contract is formed between you and gamium v2 for the provision of the selected Services. These GTC form an integral part of that contract.

1.4.
The Services are intended exclusively for individuals aged 18 or older. By registering, you declare that you are at least 18 years old and have full legal capacity to enter into contracts.

1.5.
Only residents of countries where the Services are available may use them. gamium v2 will not provide Services to Clients who:

(i) are nationals or residents of a Restricted Jurisdiction;
(ii) are incorporated or established in a Restricted Jurisdiction;
(iii) are subject to international sanctions;
(iv) have a background in financial crimes or terrorism-related offenses.

Restricted Jurisdictions include, among others, those listed in the original documentation and may be updated based on regulatory changes. gamium v2 may suspend or terminate Services for Clients falling into these categories.

1.6.
The Services mainly consist of:

  • Tools for simulating operations in financial markets.

  • Evaluation accounts and funding programs.

  • Instant funding accounts.

  • Analytical tools, educational materials, and other training content.


All trading activities take place in simulated environments with fictitious capital. The Client acknowledges that they do not acquire rights over such capital nor over any profits derived from real financial markets.

1.7.
gamium v2 may use internal real accounts and/or replicate certain Traders’ operations for internal operational purposes only. Such use does not create any proprietary rights for the Trader.

1.8.
None of the Services offered by gamium v2 constitute financial advice, portfolio management, brokerage, or regulated deposit-taking. All content is educational or informational in nature.

1.9.
Personal data are processed in accordance with the Privacy Policy available on the Website.

1.10.
Specific definitions are found in Clause 19.


2. SERVICES AND CONTRACTING

2.1.
Services are requested through the Website by completing the registration or order form and selecting the desired product (e.g., Direct Accounts, evaluation challenges, instant funding, subscriptions, etc.).

2.2.
After registration and/or purchase, gamium v2 will provide access to the Client Area and, depending on the product acquired, access to one or more compatible Trading Platforms.

2.3.
gamium v2 may offer, among others, the following types of products (current or future versions):

  • Direct Accounts

  • Evaluation Challenges (1-phase models or others as published)

  • Paid Evaluation Exams


  • Special programs (swing conditions, news restrictions, etc.)

  • Recurring subscriptions for expanded access or additional benefits

2.4.
All information provided by the Client must be accurate, complete, and up to date. gamium v2 may verify the information whenever necessary.

2.5.
If the Client provides tax or business information, or acts as a legal entity, they will be considered a business client; consumer protections may not apply.

2.6.
gamium v2 may offer individualized conditions (discounts, extensions, special pricing). These benefits are not cumulative unless expressly stated.

2.7.
For operational and risk reasons, gamium v2 may limit the number of active accounts and/or the maximum notional capital per Client (generally up to USD 2,000,000 in simulated capital unless updated).

2.8.
The contract is formalized in English and stored electronically. The valid version will always be available on the Website.


3. PAYMENT CONDITIONS, CURRENCY, AND REFUNDS

3.1.
Service fees are primarily expressed in US dollars (USD). If the Client pays in another currency, conversion will be handled by the payment provider, and the Client will be responsible for any resulting differences.

3.2.
Published prices will include applicable taxes charged by the provider when relevant. The Client is responsible for declaring and paying taxes arising from income or profits in their own jurisdiction.

3.3.
Accepted payment methods may include, without limitation:

  • Bank cards

  • International bank transfers

  • Cryptocurrencies (e.g., USDT or others accepted)

  • Electronic methods available on the Website


3.4.
For instant payments (card or similar), the transaction is considered completed once confirmed by the payment processor. For transfers, payment is considered complete once gamium v2 receives the full amount.

3.5. One-time-payment products
Most Evaluation Challenges and certain products require a single fee that grants access to the Services as described at the time of purchase.

3.7. Recurring subscriptions
For subscription-based products:

  • The Client authorizes recurring charges until the subscription is cancelled according to the Website instructions.

  • Cancellation stops future charges but does not entitle the Client to a refund for already-started billing periods, unless required by law.


3.8. Refund Policy
Generally, paid fees are non-refundable, except in cases of:

  • valid exercise of the right of withdrawal,

  • technical errors attributable to the provider,

  • specific scenarios indicated for certain products (e.g., certain Direct Account plans).


3.9. Payment disputes and chargebacks
If a Client initiates a chargeback or disputes a payment without valid grounds, gamium v2 may:

  • immediately suspend access to the Services,

  • cancel evaluation or funded accounts,

  • block future purchases.


3.10.
The Client is responsible for any payment provider fees, banking charges, or exchange differences, ensuring that gamium v2 receives the full required amount.

4. CLIENT AREA AND TRADING PLATFORM

4.1.
Each natural or legal person may generally have one single Client Area. gamium v2 may link all accounts, products, and services acquired by the Client to that same Client Area.

4.2.
From the Client Area, the Trader may:

  • Manage their products (evaluations, Direct Accounts, funded accounts, instant funding, etc.)

  • View metrics, data, and account performance

  • Access and download relevant documentation

  • Contact support through the available channels


4.3.
Access to the Client Area and Trading Platforms is restricted by personal credentials. The Client must keep these confidential and must not share them or allow other individuals to use their access.

4.4.
It is prohibited to:

  • Allow multiple people to operate the same account

  • Operate accounts belonging to different holders from the same devices or IP addresses in a coordinated manner to bypass capital or risk limits


A breach of these rules may be considered a Prohibited Practice, and the consequences outlined in these GTC will apply.

4.5.
The Services may be temporarily unavailable due to maintenance, updates, or technical issues. gamium v2 does not guarantee continuous availability and will not be liable for damages resulting from inability to access the Services.

4.6.
The Client may request cancellation of their account via written communication to support. Cancellation terminates the contract and access to all Services. Fees already paid are non-refundable unless specific exceptions apply.

4.7.
gamium v2 does not set a fixed expiration period due to inactivity. However, for technical or operational reasons, it may close inactive trading accounts, while retaining relevant information in the Client Area whenever reasonably possible.


5. GENERAL DEMO TRADING RULES AND PRACTICES

5.1. Nature of operations and simulated trading environment

5.1.
All operations executed within gamium v2 Services are carried out in demo accounts or simulated environments using fictitious capital.
Trader performance will be used exclusively for internal purposes, such as:

  • performance evaluation,

  • allocation of funded accounts,

  • calculation of profit payouts,

  • statistical analysis and service improvement.


5.2.
The Client understands that the capital shown on the platforms is simulated and does not represent real funds assigned to the Trader nor any ownership rights over the provider’s actual funds.

5.3.
gamium v2 and its affiliated entities may access all operational information of the Client and use it for analysis, improvements, internal risk management, or automated processes.
This does not entitle the Trader to any additional remuneration beyond agreed profit payouts.

5.2. Availability of platforms and systems

5.4.
The Client Area and Trading Platforms may experience temporary interruptions due to maintenance, technical failures, or external causes.
gamium v2 will not be responsible for losses or damages arising from:

  • connection interruptions,

  • latency,

  • execution errors,

  • failures of external providers.


5.3. Trading Practices

The following behaviors are considered Prohibited Practices and represent a serious breach of the contract.

gamium v2 may expand or update this list whenever necessary to maintain system integrity.

a) Exploitation of technical errors or system failures

Includes, among others:

  • taking advantage of pricing errors,

  • execution inconsistencies,

  • server failures,

  • abnormal latency,

  • unintended platform behaviors.


Any profit obtained through these practices may be invalidated.

b) Latency arbitrage

Using differences in speed between data feeds or execution systems to obtain risk-free advantages.

c) Market manipulation or external hedging

Includes:

  • opening opposite positions across multiple coordinated accounts, internal or external,

  • manipulating evaluation or funding results,

  • strategies designed to guarantee profit “without real risk.”


e) Use of robots, EAs, or unauthorized automation

The following are not permitted:

  • Expert Advisors (EAs),

  • trading bots,

  • automated scripts,

  • auto-trading systems.


Unless explicitly authorized in writing by gamium v2 for a specific product.

f) Martingale, grid, or extreme-risk strategies

Includes:

  • exponentially increasing position size after losses (martingale),

  • grid-style order networks (grid trading),

  • any technique that exposes capital to disproportionate risk,

  • opening extremely large positions during weekends for the purpose of exploiting gaps or abnormal price movements.


g) Ultra-fast scalping

It is prohibited to open and close trades within seconds or milliseconds solely to capture micro-movements.
gamium v2 may consider trades of extremely short duration as suspicious based on its internal parameters.

h) Hedging across different accounts

Opening opposite trades across different accounts in order to manipulate drawdown or risk metrics.

i) Sharing accounts, IPs, or devices

It is not permitted to:

  • allow multiple people to operate the same account,

  • operate multiple accounts from different holders using the same devices or IP addresses to evade risk limits.


j) Gambling-style trading

This includes operating impulsively, without strategy, with inconsistent lot sizes, or in a manner equivalent to betting.

5.4. Consequences of Prohibited Practices

Depending on the severity of the breach, gamium v2 may apply one or more of the following measures:

  • Remove or adjust affected trades

  • Invalidate an evaluation or challenge

  • Cancel a funded account

  • Revoke profit payouts partially or entirely

  • Suspend or block the Client’s access to the Services

  • Terminate the contract without refund

  • Permanently ban the Trader in severe or repeated cases

6. gamium v2 PROGRAM MODELS AND MAIN CONDITIONS

gamium v2 may offer the following product models:

  • Direct Accounts (PRO Accounts)

  • 1-Step Evaluation – Free Exam (“pay only if you pass”)

  • Special Programs (Swing, restricted news conditions, etc.)

  • Premium or recurring subscriptions


General rules:

  • Only Direct Accounts use static drawdown.

  • Evaluations and instant funding accounts use dynamic/trailing drawdown.

  • Daily drawdown is calculated from the equity peak when applicable.


6.1. Direct Accounts (PRO)

General Characteristics

  • Drawdown type: Static

  • Max Drawdown: 6%–8% depending on account size

  • Daily Drawdown: 3% or 4%, depending on the purchased account

  • Standard Profit Split:

    • 70% Trader / 30% gamium v2 (unless specified otherwise)


Consistency Rules

Direct Accounts may include special consistency requirements different from the 20% rule applied to evaluations.

All risk rules, prohibited practices, news rules, and operational guidelines apply.

6.2. Free Evaluation – 1-Step (“Pay only if you pass”)

Characteristics

  • Access with no initial fee

  • Profit objective: approx. 3% of initial balance (exact value per product page)

  • Max Drawdown: up to 8% trailing

  • No daily drawdown, unless updated


If the Trader passes the evaluation

  • They may activate a Funded Account

  • The Trader must pay the activation fee to formalize the funded account


If the Trader fails

  • The evaluation is considered failed

  • The account is cancelled with no payment obligation


6.3. Paid Evaluation – 1-Step Exam

Characteristics

  • Requires payment of an upfront fee

  • Max Drawdown: 6% trailing

  • Daily Drawdown: 3% based on equity peak

  • Profit objective defined per product page


Consistency Rule

No single winning day may represent more than 20% of total profits generated during the evaluation.

Failure Conditions

The evaluation is failed if:

  • max drawdown is exceeded

  • daily drawdown is exceeded

  • consistency rule is violated

  • prohibited practices occur


There is no right to refund of the fee.

6.4. Instant Funding Accounts

Characteristics

  • Immediate access to a funded account with no evaluation phase

  • Max Drawdown: 8% trailing

  • Daily Drawdown: 4% based on equity peak


Profit Split

Depends on the product; typically:

  • 50% Trader / 50% gamium v2

Consistency Rule

The best profitable day cannot represent more than 20% of total profits during the payout cycle.

Failure Consequences

  • Account cancellation

6.5. Available Assets and Leverage

Assets available for trading may include:

  • Forex

  • Indices

  • Gold (XAUUSD)

  • Commodities

  • Stocks

  • Cryptocurrency


Standard leverage ranges

  • Forex: 1:30 to 1:100

  • Indices / Gold / Commodities / Stocks / Crypto: 1:1 to 1:50


Spreads, commissions, swaps, and execution conditions depend on the third-party technology provider.

6.6. General Criteria to Pass or Fail Evaluations

To successfully complete an evaluation, a Trader must:

  1. Reach the profit objective

  2. Respect the max drawdown and daily drawdown

  3. Meet the minimum trading days (if applicable)

  4. Meet consistency rules

  5. Avoid prohibited practices


Any violation results in:

  • Immediate suspension of the evaluation

  • Cancellation of the evaluation account


7. FUNDED ACCOUNTS AND RELATIONSHIP WITH THE TRADER

7.1. Assignment of a Funded Account

If the Trader passes the evaluation and satisfies all conditions (including KYC/KYB verification), gamium v2 may assign them a Funded Account, which may operate through real or simulated structures depending on internal policies.

Assignment is not automatic; gamium v2 reviews full compliance before activation.

7.2. Legal Relationship

The contractual relationship regarding funded accounts is between the Trader and MCX Limited (gamium v2) unless a specific program states otherwise.

The Trader acknowledges that they operate under ongoing evaluation and that gamium v2 may monitor and analyze trades at any time.

7.3. Ownership of Capital

All capital assigned in a Funded Account is exclusive property of gamium v2.

The Trader:

  • does not acquire ownership rights over the capital

  • does not control real funds used internally by the company

  • cannot demand real execution of simulated or replicated trades


Operations represent simulated operative instructions, used to calculate eligibility and payouts.

7.4. Profit Split

Standard profit distributions depend on the product. Common structures include:

  • 70% Trader / 30% gamium v2 for evaluation-based funded accounts

  • 50% / 50% for instant funding accounts

7.5. Payout Frequency

Typically:

  • Traders may request payouts every 30 days


Some programs may allow:

  • payouts every 14 days, or

7.6. Minimum Payout

The general minimum payout request amount is:

The Trader is responsible for:

  • network fees

  • KYC/KYB is incomplete or rejected

  • consistency was manipulated

During an investigation:

  • payouts may be paused

  • funded accounts may be frozen

  • new products cannot be activated


7.9. Modification or Termination of Funded Accounts

gamium v2 may:

  • adjust parameters

  • modify conditions

  • suspend or terminate funded accounts


if rule violations, suspicious activity, or extreme-risk behavior occurs.

8. NEWS TRADING POLICY

8.1. Trading during news in evaluations

During evaluation phases (including free and paid 1-step exams):

  • Trading during high-impact news is allowed,
    unless a specific product explicitly includes restrictions published in its description.


The Trader must check the most updated information on the platform or website, as rules may be modified to ensure operational stability.

8.2. Trading during news in funded accounts

In Funded Accounts, strict restrictions apply:

It is prohibited to, within the restricted window:

  • open positions,

  • close positions,

  • modify existing trades,

  • place new pending orders,

  • cancel or modify pending orders.


Restricted window (news window):

  • 5 minutes before the event, and

  • 5 minutes after the exact event time.


Any trading activity within this window will be considered a direct rule violation.

8.3. Definition of “high-impact news”

High-impact news includes:

  • All economic events labeled as High Impact,
    based on widely recognized economic calendars used in the industry.


Examples include:

  • FOMC Statement

  • Non-Farm Payroll (NFP)

  • CPI / Inflation Reports

  • GDP Releases

  • Interest Rate Decisions

  • High-impact PMI releases

  • Key Employment Reports

  • Central Bank Minutes


gamium v2 may define or update its list of monitored events at any time.

8.4. Consequences of trading during high-impact news

If a Trader opens, closes, or modifies any trade inside the restricted window:

gamium v2 may apply any of the following:

  • Remove profits generated during that payout cycle

  • Invalidate the entire payout cycle

  • Cancel the Funded Account (if severe or repeated)

  • Suspend pending payouts while the case is reviewed


Repeated violations may result in:

  • permanent suspension,

  • closure of active funded accounts,

  • prohibition from future participation in funding programs.


8.5. Specific strategies related to news

gamium v2 may allow, limit, or prohibit strategies such as:

  • straddles,

  • strangles,

  • placing pending orders near price during news,

  • high-volatility positioning.

Any additional rules will be communicated through official channels.


9. KYC / KYB AND VERIFICATION

9.1. Verification obligation

gamium v2 may request identity verification (KYC) or business verification (KYB) at any moment, including:

  • before activating a Funded Account,

  • before the first payout,

  • at any time required for compliance, fraud prevention, internal audits, or risk management.


The Client must provide accurate and updated information.

9.2. Accepted identity types

Verification may be required for:

1. Natural persons:

  • Valid ID, passport, or equivalent

  • Recent proof of address


2. Independent workers / freelancers:

  • Identification documents

  • Tax registration (if applicable)


3. Legal entities:

  • Certificate of incorporation

  • Documentation of shareholders and UBOs

  • Proof of representation authority


9.3. Verification deadline

Once verification is requested, the Trader will have:

up to 30 calendar days

to submit the documents and complete the process.

Failure to comply may result in:

  • invalidation of evaluations,

  • inability to activate funded accounts,

  • suspension or cancellation of payouts,

  • account closure.


9.4. Compliance with international regulations

All contractual relationships related to funded accounts are subject to laws in Saint Lucia, and internationally recognized standards on:

  • anti-money laundering (AML),

  • counter-terrorism financing (CFT),

  • economic sanctions,

  • identity verification.


gamium v2 may request additional documentation if:

  • the jurisdiction is considered high-risk,

  • suspicious activity is detected,

  • there are inconsistencies in the data provided,

  • periodic reviews require updates.


9.5. Preventive suspension of services

gamium v2 may temporarily suspend a Trader's account if:

  • suspicious activity is detected,

  • provided documentation is insufficient or questionable,

  • activity does not match the declared profile,

  • signs of fraud or manipulation appear.


During suspension:

  • payouts cannot be requested,

  • new activations cannot be processed,

  • additional documentation may be required.


9.6. Inaccuracy or falsification of documentation

It is a serious violation if the Trader:

  • submits false, altered, or forged documents,

  • hides relevant information,

  • uses third-party identities,

  • uses unverifiable or fictitious corporate structures.


Consequences may include:

  • immediate termination of the contract,

  • cancellation of funded accounts,

  • deletion of pending payouts,

  • permanent ban from gamium v2.


10. SCALING PLAN

gamium v2 may offer a Scaling Plan applicable to certain funded accounts derived from successful evaluations.
Its purpose is to reward Traders who demonstrate profitability, consistency, and proper risk management.

10.1. Application of the Scaling Plan

The Scaling Plan applies to:

  • funded accounts from completed evaluations,

  • programs explicitly compatible with scaling,

  • accounts with clean operational history and no violations.


Generally, it does not apply to Instant Funding Accounts unless explicitly stated.

10.2. Benefits of the Scaling Plan

A Trader who meets the requirements may receive:

  • increases in account size (e.g., 25% increments per scaling stage),

  • improvement in profit split,

  • other operational benefits published by gamium v2.


The exact increment depends on the product and published conditions.

10.3. Requirements to qualify for scaling

gamium v2 will publish specific requirements per program. Generally, the Trader must:

  1. Maintain accumulated positive profitability

  2. Demonstrate consistency, meaning:

    • No single day accounts for more than 20% of total profits


  3. Complete a minimum number of profitable months


  4. Submit at least one payout request (depending on program)


  5. Have no rule violations, including:

    • drawdown breaches

    • prohibited practices

    • news rule violations

    • suspicious or extreme-risk activity


Violations may reset or invalidate the scaling cycle.

10.4. Maximum account size limit

The maximum aggregated capital a Trader may reach through scaling is:

up to USD 2,000,000,

unless gamium v2 publishes a different limit later.

This maximum includes all accounts linked to the same Trader.

10.5. Periodic scaling evaluation

gamium v2 will periodically review accounts eligible for scaling.

  • If the Trader meets all criteria → Scaling is applied

  • If not → Scaling is not granted that cycle, but the Trader may continue operating normally


Failure to meet criteria does not result in losing the funded account; it only halts scaling for that cycle.

11. USE OF THE WEBSITE, CONTENT, AND INTELLECTUAL PROPERTY

The Website, Client Area, Trading Platforms, their interfaces, educational materials, logos, trademarks, texts, graphics, and any associated digital content are the exclusive property of gamium v2 or its licensors.

All such elements are protected by:

  • copyright laws,

  • intellectual property laws,

  • trademark regulations,

  • database protection laws,

  • and applicable international agreements.


11.2. Limited License to the Client

gamium v2 grants the Client a revocable, limited, non-exclusive, non-transferable license to use the Services solely for personal purposes and in accordance with these GTC.

No ownership rights over software, tools, systems, or materials are granted.

11.3. Prohibited Activities Regarding Website or Services

The Client agrees not to:

  • reproduce, distribute, sell, sublicense, or commercially exploit any Website content,

  • modify, decompile, reverse engineer, or tamper with the software,

  • use automated tools for mass data extraction (“scraping”),

  • inject scripts or take actions that overload the servers,

  • attempt to bypass security systems or geographic restrictions,

  • copy the operational structure, look-and-feel, workflows, or materials to create similar or competing services.


Any violation may result in immediate suspension or termination of the Client’s access.

11.4. External Links and Third-Party Services

The Website may include links to services, content, or platforms owned by third parties.
gamium v2 does not guarantee, nor is responsible for:

  • their availability,

  • accuracy,

  • reliability,

  • security,

  • or content.


Use of third-party services is entirely at the Client’s own risk.

11.5. Technical Modifications and Updates

gamium v2 may perform, without prior notice:

  • structural changes to the Website,

  • software updates,

  • user experience improvements,

  • maintenance tasks,

  • partial or total temporary suspension of the service.


The Client acknowledges that such actions may affect service availability and do not entitle them to compensation.


12. LIABILITY, DISCLAIMERS, AND FORCE MAJEURE

12.1. Services Provided “As Is”

The Services are provided “as is” and “as available” without any guarantee of:

  • results,

The Client operates at their own risk.

12.2. Limitation of Liability

To the fullest extent permitted by law, gamium v2 is not liable for:

  • loss of profits or income,

  • loss of data,

  • indirect, incidental, special, or consequential damages,

  • investment decisions made by the Client outside gamium v2 systems,

  • failures of third-party systems (brokers, liquidity providers, platforms),

  • interruptions in third-party services.


gamium v2’s total liability for any claim not excludable by law is limited to:

the amount of fees paid by the Client in the 90 days prior to the event giving rise to the claim.

12.3. Force Majeure

gamium v2 is not liable for failure to provide services caused by force majeure events, including but not limited to:

  • natural disasters,

  • wars or armed conflict,

  • pandemics or health emergencies,

  • global infrastructure failures,

  • power outages or major network disruptions,

  • government or regulatory restrictions,

  • international sanctions or trade blockages.


During a force majeure event, services may be suspended partially or fully without compensation.

12.4. Additional Disclaimers

gamium v2 does not guarantee:

  • that the Trader will receive a funded account,

  • that they will qualify for scaling upgrades,

  • that demo results represent real-market performance,

  • availability of payouts during investigations for potential violations or fraud suspicions.

13. RIGHT OF WITHDRAWAL (CONSUMERS)

13.1. Withdrawal Period

If the Client acts as a consumer, they are entitled to withdraw from the contract within:

14 calendar days

from the date of purchase of the service.

This right does not apply to companies, legal entities, or business users.

13.2. Condition for Exercising the Right of Withdrawal

The right of withdrawal remains valid only if the Client has not begun using the paid service, which includes:

  • opening a trade in an evaluation or paid account,

  • accessing premium content that activates the service,

  • initiating any functionality considered as “service consumption.”


If the Client has already used the service, the right of withdrawal is automatically extinguished.

13.3. How to Exercise Withdrawal

The Client must send a written request to the support email provided by gamium v2.

The request must be sent within the 14-day period and must include:

  • full name,

  • registered email address,

  • purchased product,

  • a clear declaration of the intention to withdraw.


13.4. Refunds

Once a valid withdrawal is confirmed:

  • gamium v2 will issue the refund within a maximum of 30 days,

  • using the same payment method used for the purchase unless otherwise agreed.


Refunds will not be issued if:

  • the service has been consumed,

  • the account has been activated,

  • trades have been opened,

  • any part of the service has been used.


14. BREACH OF THE GTC

gamium v2 may take immediate action if the Client violates these Terms and Conditions, particularly if the Client:

  • uses the Services in contradiction with age limits, restricted jurisdictions, or international sanctions;

  • provides false, incomplete, or outdated information;

  • engages in Prohibited Practices;

  • attempts to manipulate metrics, results, drawdown, or consistency;

  • harms the reputation or legitimate interests of gamium v2;

  • attempts to bypass security systems, technical limitations, or operational restrictions.


14.1. Measures gamium v2 May Apply

Depending on the severity of the violation, gamium v2 may:

  • suspend the Client’s access temporarily,

  • limit or restrict access to products,

  • cancel active evaluations or funded accounts,

  • invalidate profits,

  • block pending payouts,

  • prohibit future purchases,

  • permanently close the Client’s account,

  • terminate the contract without refund.


These measures may be applied even preventively when there is reasonable suspicion of abuse or manipulation.


15. COMMUNICATIONS

15.1. Official Communication Channels

Communications between gamium v2 and the Client will primarily occur via:

  • the Client Area,

  • the Client’s registered email,

  • or other verified channels used by the company in special cases.


All electronic communications are considered legally in writing.

15.2. Obligation to Keep Contact Information Updated

The Client must keep their email address and contact information up to date.
If the Client does not receive messages due to outdated information, they will still be deemed properly notified.

15.3. Operational Messages

gamium v2 may send notifications regarding:

  • product updates,

  • changes to evaluation conditions,

  • maintenance notices,

  • rule reminders,

  • requests for additional documentation.


These notifications are considered part of the service and are not promotional communications.


16. MODIFICATION OF THE GTC

16.1. Right to Modify

gamium v2 may modify these General Terms and Conditions when deemed necessary for:

  • legal or regulatory reasons,

  • technical or operational needs,

  • commercial adjustments,

  • service improvements,

  • product updates.


16.2. Notification to the Client

Modifications will be notified through:

  • the Client Area, or

  • the Client’s registered email address.


Notifications will generally be sent at least 7 days prior to the effective date, except in urgent cases requiring immediate enforcement.

16.3. Acceptance or Rejection by the Client

If the Client disagrees with the modifications:

  • they may reject the new GTC

  • and request termination of the contract before they take effect.


If the Client continues to use the Services after the effective date:

They are considered to have accepted the updated GTC.


17. GOVERNING LAW AND JURISDICTION

17.1. Governing Law

These GTC, and any legal relationships arising from them, shall be governed by the laws of Saint Lucia, without prejudice to mandatory consumer protection laws that may apply to Clients domiciled in other jurisdictions.

17.2. Jurisdiction

Any dispute, claim, or controversy relating to the Services or these GTC shall be submitted to the competent courts of Saint Lucia, unless consumer protection laws require another jurisdiction.


18. DURATION AND TERMINATION OF THE CONTRACT

18.1. Duration

Unless the product is subscription-based, the contract remains in force for the duration necessary to complete:

  • the purchased Evaluation or Challenge,

  • the operation of a Funded Account,

  • or the specific Service acquired.


The contract will end when:

  • the evaluation is passed or failed,

  • the funded account is cancelled,

  • the Client requests deletion of their Client Area,

  • gamium v2 terminates the contract in accordance with the GTC.


18.2. Subscriptions

For subscription products, the contract renews automatically based on the billing cycle until it is validly cancelled by either party.

18.3. Termination by Either Party

Both the Client and gamium v2 may terminate the contract by giving:

7 days’ notice

without prejudice to rights already acquired or amounts pending.


19. DEFINITIONS

For the purposes of these GTC:

Client Area:

Private dashboard accessible from the Website where the Client manages products, data, and accounts.

Trading Platform:

Electronic interface provided by third parties for executing demo or simulated trades.

Simulated Capital:

Nominal amount selected by the Client during purchase, used exclusively for evaluation and simulation purposes.

Restricted Jurisdictions:

Countries or territories where gamium v2 does not offer Services due to regulatory, compliance, or risk considerations.

Prohibited Practices:

Actions listed in Clause 5 (latency arbitrage, technical exploitation, cross-account hedging, unauthorized automation, martingale/grid strategies, etc.).

Funded Account:

Account assigned to a Trader who passed an evaluation or purchased an instant funding product, subject to specific rules and profit-sharing conditions.

Profit Split:

Distribution of profits between the Trader and gamium v2, depending on the program.

Drawdown (DD):

Maximum loss permitted in an account, which may be static or dynamic depending on the product.
